Case Overview

definition

Juvenile cases are court-centered procedures (the juvenile divisions of the Family Court and the District Court), and they comprehensively consider the child’s home environment and developmental background to help promote healthy growth
They focus on protection and guidance, recovery, and reintegration into society rather than punishment. Features include closed hearings, encouraging family participation, and the use of specialists (classification examiners, investigators, etc.).

Characteristics by Case

01
Juvenile offense case (focused on juvenile offenders aged 14 and older)

A juvenile aged 14 or older who commits an offense is recognized as having criminal responsibility and may be investigated by the police or prosecutors (formally booked in a criminal case) and, depending on the circumstances, may be subject to criminal punishment (imprisonment, fines, etc.). However, depending on the motive for the offense, the juvenile’s environment, and other factors, the case may be referred as a juvenile protection case instead of being prosecuted criminally, resulting in protective measures. Key issues: 1) Assistance with statements during police/prosecutor investigations, and defense against an arrest warrant 2) Arguments to minimize the level of punishment if the case is sent to criminal court (e.g., suspended sentence, probation) 3) Seeking a transfer to the juvenile court or arguing the appropriateness of such a transfer * Negotiating a settlement with the victim and coordinating damages compensation
