1. Client's Crisis
The client, who had been sued for divorce by their spouse, was already nearing 30 days since receiving the complaint. The client had clear grounds of fault, while the other party had none, making it an objectively strong case for the plaintiff to win. In a desperate effort to protect the family, the client came to Law Firm Jonjae.
2. Key Issue
To obtain a judgment dismissing the divorce despite the client's fault, we had to prove that the conduct did not rise to the level of destroying the family and persuasively present the possibility of restoring the marital relationship. With the other party firmly intent on divorce, this was a difficult case that required a legal argument for the need to preserve the family.
3. Jonjae's Strategy
Attorney Ji-Sang Yoon, the firm's representative attorney, developed the written submissions based on his litigation experience as a former chief judge. He focused on arguing that the client's fault did not amount to a breakdown of the family and presented concrete evidence of the client's dedication to the family. By securing marital counseling records and expert opinions, he demonstrated the possibility of reconciliation and comprehensively explained the impact on the children as well.
4. Outcome and Recovery
The trial court took into account the client's efforts, the minor nature of the fault, and the impact on the children, and dismissed the divorce. Although the other party appealed, the same conclusion was upheld on appeal, resulting in a dismissal of the divorce in both the first and second trials. The client was able to protect the family and begin restoring family relationships.
