Hello. This is Law Firm Jonjae.
OMEGA X has achieved a final victory in the merits case over the termination of its exclusive contract with its former agency, Spire Entertainment.
Final ruling by the Korean Commercial Arbitration Board
This case was handled through the Korean Commercial Arbitration Board. On March 27, 2024, the Board recognized former Spire Entertainment director Kang Seong-hee’s acts of assault, verbal abuse, indecent assault, threats, and more. Accordingly, it finally ruled on the loss of validity and termination of the exclusive contract on the grounds of a breach of the duty to protect personality rights under the exclusive contract.
It also recognized the mental harm suffered by the OMEGA X members due to Kang Seong-hee’s breach of contract and tortious conduct, and the legitimacy of the damages claim was also legally confirmed.
From the press conference to final victory — the full course of the OMEGA X case
In November 2022, all OMEGA X members held a press conference at the Seoul Bar Association building together with Law Firm Jonjae managing partner Attorney Noh Jong-eon and Attorney Seo Ju-yeon, and publicly disclosed the harm they had suffered. Afterwards, a provisional injunction suspending the effect of the exclusive contract was granted by the court in January 2023, and in May 2023 they agreed to terminate the exclusive contract, after which OMEGA X moved to its current agency, IPQ. The final victory in the merits lawsuit, which was transferred to the Korean Commercial Arbitration Board, was then rendered.
Meanwhile, the complaint filed by Spire Entertainment against Attorney Noh Jong-eon for spreading false information resulted in a police decision of non-referral for lack of charges.
For the eleven who could not give up on their dreams
Law Firm Jonjae Entertainment Law Center hopes that the OMEGA X members, who could not give up on their dreams and had no choice but to endure unfair treatment because they could not betray the love and support of their fans, will once again pursue their dreams and be relieved of their injustice. Please give your continued support for OMEGA X’s dreams and courage.
Full official statement from IPQ
We hereby inform you of our position and the measures planned going forward.
1. After winning the injunction to suspend the effect of the exclusive contract, OMEGA X concluded a tripartite agreement in March 2023 with Danal Entertainment and Spire Entertainment regarding termination of the exclusive contract and transfer of IP, through the former manager as representative. Despite this agreement, Spire Entertainment has claimed that the exclusive contract rights remain with it, arguing that no exclusive-contract-termination agreement was executed. Due to Spire Entertainment’s fault, we are proceeding with steps to invalidate the tripartite agreement.
2. According to the decision on the injunction prohibiting the deletion of videos requested against the YouTube channel 'Injiwoong,' most of the factual grounds for the tampering allegations asserted by Injiwoong were found to be false. Injiwoong is continuing to upload videos in violation of the court order, and we plan to request the court to impose indirect compulsion fines based on the number of days of violation.
Currently, the assault case involving former Spire Entertainment director Kang Seong-hee is undergoing supplementary investigation after being sent to the prosecution, and the indecent assault case is also under police investigation. The defamation and obstruction of business cases against Spire Entertainment CEO Hwang Seong-woo, Kang Seong-hee, and YouTuber Injiwoong are also under investigation.
IPQ will do its utmost to reveal the truth and take legal action in the ongoing lawsuits and investigations. We would like to inform you that we will continue to respond firmly and without leniency to the unlawful acts of Spire Entertainment and all others involved in this matter.
