This case began when the husband falsely registered the son of a subordinate employee who had died in an accident decades ago in the family register. In response to the bereaved family’s claim for return of a statutory reserved portion worth about 100 million won, we countered with a court-ordered DNA test and a lawsuit to confirm the absence of a parent-child relationship, and obtained a judgment fully granting the claim. We also practically organized the exclusion period under Article 865(2) of the Civil Act and strategies for defending the opposing party’s status as an heir.
